This FLPA Twilight seminar is a panel discussion exploring the manner in which we, as practitioners, and the Courts can effectively usefully deal with historical domestic and family violence in parenting proceedings.

As part of the discussion, we cover how historic family violence might be dealt with in parenting cases where there is cogent evidence that a party (the aggrieved) has been the victim of violence, the aggrieved has been traumatised by that violence and continues to experience trauma, including in circumstances where there is arguably a benefit to the child in having a meaningful relationship with both parents. We will cover issues relating to gatekeeping behaviours, how the Egg Shell Skull Rule might impact thinking and the intersection between a child’s needs and the needs of their carers, and how as practitioners we can respond to these issues.
